Having an L&I attorney probably won't help against the behemoth bully L&I. But if you're going to fight L&I this law firm has the experience and fortitude to stand up to the L&I bully.
This law firm represented me for my L&I claim. Kathy Comfort is a very experienced L&I attorney and was a great help with fighting L&I to force them to pay me what they owed. But when it came time to fight the denial and closing my claim Kathy told me I need "tens of thousands of dollars" to pay for truly independent medical testing to file the appeal. All of the services and treatment with L&I isn't "independent" because L&I paid for it and therefore can't be used for an appeal. To fight an L&I denial you have to be willing to put up a lot of money or use your own health insurance to fight a denial and even then there is no guarantee you will win your appeal. L&I is a money making machine for the state with huge profits and paying out as little as they can get away with.
I was hit by a car while working in a marked roadwork zone. Extensive medical bills that were covered by L&I totaling $28,000+. That is called a third party claim because it was not my fault or my employers fault. The driver had $50,000 insurance coverage. From the insurance pay out about $18,000 went to L&I to reimburse them for some of my bills. It would have been much more but my personal injury attorney negotiated them down. Trying to sue the driver was a big waste of time because he had no assests like property, retirement etc.
Not long after being hit I had several hours of testing with Dr Kenneth Muscatel (in Seattle). He stated in his assesment that my vertigo and other problems were the result of depression, not because I had been hit by a car receiving significant head trauma and my body being thrown forward 10 feet and my head hitting the pavement so hard that I had a golf ball sized lump on the back of my head for a month. Left side of my body and head received the impact of the car. The impact of the windshield to my head was so significant that I have hearing loss in my right ear. Left shoulder muscle strain due to impact with the windshield, couple cracked left ribs and according to my spine doctor, Kevin Shoenfelder, "You would have been paralyzed if the canal inside the vertebrae of your neck had not been larger than normal allowing the spinal cord to move when your head and neck impacted the windshield." (Very sobering and surreal moment hearing that.)
Yet none of that is enough proof for "doctor" Muscatel of a significant injury causing vertigo and many other cognitive problems that he tried to dismiss as depression. The only reason why L&I couldn't dismiss my claim at that point was because I WAS HIT BY A FREAKIN CAR, with numerous cuts and stitches on my face from the windshield shattering, had to use a walker due to significant vertigo. Regardless of what that hack of a "doctor" Muscatel says I sustained significant undeniable injuries that were well documented by the great ER staff and other people at Saint Joseph Hospital. The doctors and specialists also made documentation on their own accord that my injuries were made worse by pre-existing conditions.
Like a spinal fusion that didn't allow my back to bend and absorb the impact and forced more of the impact to my neck and head. Also scoliosis that positions my head farther forward then normal and the impact caused significant muscle strains which cause vertigo and headaches. With my head/neck position already being bad from scoliosis, then add in neck trauma there's not much that can be done.
DO NOT get injured or risk getting injured on a job in Washington State. The state will do everything they can to deny your claim so they don't have to pay time-loss or medical and kick you to the curb.
